Terms of Service

Please read these terms carefully before using Seleckt.

1. Acceptance of Terms

By accessing or using Seleckt (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

2. Service Description

Seleckt is a photography business management platform that provides:

  • Gallery hosting, proofing, and client selection workflows
  • Photo delivery and download management
  • Invoicing and payment collection
  • Contract creation and electronic signatures
  • Client relationship management
  • Transactional email notifications

3. Account Registration & Security

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised access.

4. Intellectual Property & Photo Ownership

Photographers retain all intellectual property rights to their photographs and content uploaded to the Service. By uploading content, you grant Seleckt a limited, non-exclusive, royalty-free licence solely to store, process, and deliver your content as necessary to provide the Service.

Seleckt does not sell, sublicense, or claim ownership of any user-uploaded content. This licence terminates when you delete your content or close your account.

Galleries may be subject to expiry dates, access controls, and download limits as configured by the photographer. Seleckt is not responsible for client access issues arising from expired galleries or exhausted download limits. Photographers are responsible for communicating gallery terms to their clients.

6. Payment & Subscriptions

  • Payment processing — all payments are processed securely through Stripe. We do not store credit card information.
  • Billing currency — subscription fees are billed in Malaysian Ringgit (MYR).
  • Refunds — subscription fees are non-refundable except where required by applicable law. Contact us within 14 days of a charge for refund requests.
  • Photographer-client invoices — invoices created by photographers for their clients are the sole responsibility of the photographer. Seleckt facilitates invoice creation but is not a party to the photographer-client transaction.

7. Acceptable Use

You agree not to use the Service to:

  • Upload, store, or distribute illegal, obscene, or harmful content
  • Distribute malware, viruses, or other harmful software
  • Scrape, crawl, or otherwise extract data from the Service in an automated manner
  • Impersonate another person or entity
  • Interfere with or disrupt the Service or its infrastructure
  • Violate the intellectual property rights of others

8. Connected cameras (USB)

8.1 What the feature is. The USB feature, part of Seleckt Live, lets the app receive photos from, and where supported control, a Sony camera connected to your device by USB. Seleckt uses Sony’s camera communication protocol under an agreement with Sony Corporation. That agreement requires us to tell you the points in section 8.2 and to obtain your confirmation of them. We may add or remove supported camera models at any time.

8.2 Sony’s requirements. Sony requires that we tell you, and that you confirm, the following:

  1. Warranty. Under Sony’s terms, once a Sony camera, lens or flash is used or controlled through Seleckt, including only to receive photos from it, that device falls outside Sony’s manufacturer warranty, as separately specified by Sony.
  2. Prohibited uses. You must not use Seleckt, or any camera, lens or flash connected to it: (i) to design, develop, manufacture, customise, use, install, inspect or store Arms; (ii) to transport explosives, chemical or biological weapons or other harmful items; or (iii) for military activities such as intelligence, surveillance and reconnaissance. “Arms” means products, software, technologies or services designed for combat attack (killing or destruction) or that could be diverted and employed for combat attack, including parts, accessories and software specially designed for them, and includes any type of gun (including hunting and sport guns) and telescopic sights for guns; tanks, battleships, submarines and fighter aircraft including attack helicopters; explosives; biological or chemical weapons; missiles; unmanned aerial vehicles equipped with offensive weapons, including those able to disseminate biological or chemical weapons; and devices or programs specially designed for guidance or attitude control of any of these. You confirm that you do not intend to use Seleckt or a connected device for any of these purposes, and you must not pass Seleckt to anyone who does.
  3. Seleckt is not a Sony product. Sony is not the owner, developer or licensor of Seleckt and does not sponsor or endorse it.
  4. Support. All support for Seleckt is provided by us, not by Sony. Contact support@seleckt.app.

Before you use the app for the first time, and again if these points change, the app asks you to confirm them. We keep a record of your confirmation as described in our Privacy Policy. Nothing in this section affects rights you have under law that cannot be excluded, including under the Consumer Protection Act 1999 where it applies to you.

8.3 How you may use the feature. You may use the USB feature only to receive photos from, or control, a Sony camera, lens or flash in its normal use and in line with Sony’s instructions for that device. You must not: (a) reverse engineer, decompile or attempt to derive the camera communication protocol or any part of Seleckt that implements it; (b) modify, tamper with, interfere with or circumvent any security or usage-control feature of the camera, the connection or Seleckt; (c) introduce malicious code to the camera or to Seleckt through the connection; (d) place an unreasonable or disproportionately large load on the camera or on Seleckt’s services; (e) use the feature in any environment that requires fail-safe performance, such as life support, aviation, nuclear or weapons systems, for which it is not designed; or (f) use or export the feature in breach of export control laws that apply to you.

8.4 Changes and withdrawal. We may change, suspend or withdraw the USB feature at any time, including remotely and without notice where Sony requires it or our agreement with Sony ends. No refund or credit is given for a change, suspension or withdrawal of the USB feature.

8.5 Your equipment. Seleckt reads photos from a connected camera and does not change its settings or the files on its memory card. You connect your equipment at your own risk. To the extent permitted by law, we are not liable for damage to, malfunction of, loss of data on, or loss of warranty cover for, any camera, lens, flash, memory card or other equipment used with Seleckt.

8.6 Trademarks. “Sony” and Sony product names are trademarks of their owners and are used only to identify compatible products.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Seleckt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the fees paid by you in the 12 months preceding the claim.
  • Seleckt shall not be liable for failures or delays caused by circumstances beyond our reasonable control (force majeure), including natural disasters, internet outages, or third-party service failures.

10. Indemnification

You agree to indemnify and hold harmless Seleckt, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

You will indemnify and hold harmless Seleckt Digital Solutions against all claims, losses, damages and costs, including reasonable legal fees, brought or incurred by any third party, including Sony Corporation and its suppliers, arising from your breach of section 8, your use of a camera, lens, flash or other equipment with Seleckt, or your use of the USB feature outside its normal use. This indemnity does not apply to the extent the law does not allow it.

11. Termination

  • You may close your account at any time. Upon closure, you will have 30 days to export your data before it is permanently deleted.
  • We may suspend or terminate your account immediately if you violate these Terms or engage in activity that threatens the security or integrity of the Service.
  • Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. For international users, mandatory consumer protection laws of your jurisdiction apply to the extent they cannot be waived by contract.

13. Changes to Terms

We may update these Terms from time to time. We will provide at least 7 days’ notice of material changes via email to the address associated with your account. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

Where a change is required by a licensor of technology used in Seleckt, such as Sony, we may make it on shorter notice than set out above. A change to the points in section 8.2 takes effect for you when you confirm the updated acknowledgement in the app.
